At the heart of this, there are still two decisions that Maguire made.
1) Confronted with a whistleblower report that involved Trump and Barr, he took that complaint to the White House and DOJ to ask them if he could go ahead.
2) The White House never formally invoked privilege, and the OLC seems to have left Maguire an out in which he could have gone ahead with releasing the complaint.
But Maguire didn’t hand over the complaint. Or even make Congress aware of the complaint.
